France 44 uses a local courier to deliver its merchandise within the metro area. Rates include packaging and handling and are based on home or office delivery. France 44 recommends providing a daytime business address for all deliveries. A person 21 years of age must be available at the time of purchase to sign for the delivery. Prior to delivery, a 2-hour time frame will be established with the recipient , during which time the package will arrive. If the delivery is incomplete (i.e. no one was available to sign for it), the sender will incure any additional fees associated with second or third attempts at delivery.
Out of State Shipping Restrictions for Beer and Wine
France 44 must comply to shipping regulations set forth by states who accept wine shipments from Minnesota. Gift baskets which include wine also must follow these restrictions.We can ship wine to: AK, AZ, CA, CO, DC, FL,GA, HI, ID, IN, LA, MI, MN, NE, NV, NH, ND, OR, SC, TX, VA, WA, WY.At this time, we are prohibited from shipping wine to any state not listed. For some states in the union, it is illegal for anyone to ship wine into that state without the proper permits. Furthermore, it may be considered a felony to ship wine to some prohibited states (these are marked with an asterisk*): AL, AR, DE, FL*, IN*, KS*, KY*, MA, MD*, ME, MI, MS, NJ, NY, OH, OK, PA, SD, TN*, UT*, VT. Non-alcoholic and Liquor Shipping Regulations
Wine and Bar Accessories, glassware, gourmet food items, as well as Gift Baskets without alcohol can be shipped locally and anywhere in the United States. France 44 is not allowed by law to ship Liquor to any addresses out-side the state of Minnesota.
Sales Tax on Merchandise and Shipments
Minnesota Department of Revenue Tax
Code (Section 137) requires France
44 to collect tax on the products
it ships to MN addresses. France
44 applies 9.65% tax on the subtotal
of all alcoholic beverages and
7.15% on non-alcoholc merchandise
and catering. Packaged gourmet
items are not taxed. Delivery fees
are taxed at 7% rate. All
out-of state shipments are not
subject to sales taxes.
Sale Terms
All sales are F.O.B. 4351 France Avenue South, Minneapolis, MN 55410. Customer assumes all legal liability for wine and merchandise shipped from point of sale, and guarantees that the recipient is 21 years of age or older. Customer indemnifies and holds France 44 harmless from any liability or damage incurred as a result of shipment. Purchase price excludes shipping, insurance, gift packaging and sales tax.
Refused Shipments/Undeliverable
Merchandise
In the event that a France 44 shipment is refused/undeliverable,
the sender will be notified. The product will be returned to
inventory and a credit issued on the customer’s card,
minus shipping and handling charges. Reshipment to an alternative
address is extra and will be charged to the customer’s
card to fulfill the delivery.
Product Availability and Backorders
All orders are subject to email confirmation,
usually within 72 hours of placing an order.
Customer will be contacted by France 44 if an item becomes unavailable
and offer to send a substitute, otherwise the order will be shipped
with merchandise on hand. France 44 will to confirm status of a backorder
and whether it should be shipped when available or cancelled altogether.
Returns and Defective Merchandise
Any products that are returned to France 44
by the common carrier will be refunded to the purchaser with
a 15% restocking fee. Shipping charges are NON-REFUNDABLE.
It is the SOLE RESPONSIBILITY of the PURCHASER to ensure that
an adult, aged 21+ years, is available to accept the shipment.
All products are shipped in good condition. Any claims for
damage are the responsibility of the PURCHASER and must be
filed with the common carrier.
Pick-up/Will Call/Abandonment
After an order is confirmed, those orders specified for Pick-up will be in France 44s Will Call area under the order number. Orders will be available within 7 business days. Customer or an authorized representative will need to present a valid I.D. and be age 21 or older at the time of pick up. Customer will be notified at 30, 60 and 90 days if an order has not yet been picked up. After 120 days a final notice will be sent. Unclaimed merchandise is considered abandoned and becomes the property of France 44. No credits or refunds will be issued for abandoned merchandise.
